A Litigation Practice Built on
Precision and Accountability
Prescott & Hargrove PLLC represents individuals and businesses in disputes where documentation, timing, and structured legal strategy determine the outcome.
Substance Over Volume
We founded Prescott & Hargrove with a clear conviction: the most effective legal representation is built on thoroughness, not theatrics. Every matter we accept receives focused attention from experienced attorneys who have handled similar disputes before and understand what moves the needle.
Our firm does not operate on high volume. We maintain a deliberately focused caseload so that each client receives the depth of analysis and strategic planning their matter requires. This means we are selective about the cases we take—and committed to the ones we do.
Disputes Requiring Structured
Legal Engagement
Our practice centers on matters where the strength of the evidentiary record, the precision of legal arguments, and the calibration of escalation strategy directly impact the result.
Consumer Financial Disputes
We represent individuals whose funds have been withheld, accounts restricted, or transactions reversed without adequate justification. These disputes often involve payment processors, exchanges, custodial platforms, or financial institutions whose internal review processes lack transparency or accountability.
Business & Contract Conflicts
We handle commercial disputes involving breach of contract, vendor disagreements, service-level failures, and partnership conflicts. Our approach emphasizes documentary evidence, contractual interpretation, and measured escalation through negotiation or litigation.
Regulatory Complaint Strategy
When a dispute involves a regulated entity, we develop parallel strategies that combine direct legal engagement with appropriately filed regulatory complaints to state attorneys general, the CFPB, the FTC, or relevant financial regulators.
Digital Asset & Platform Disputes
As digital asset platforms and fintech services grow, so do disputes involving frozen funds, unexplained account actions, and platform terms applied selectively or retroactively. We have experience navigating these matters across jurisdictional and technological complexity.
How We Approach
Dispute Resolution
Pre-Suit Strategy vs. Litigation
Not every dispute requires a lawsuit. In many cases, a well-documented demand letter, a formal regulatory complaint, or a structured settlement negotiation can achieve the client’s objective faster and at lower cost than court proceedings. We evaluate every matter for pre-suit resolution opportunities before recommending litigation.
When litigation is warranted, we file in the jurisdiction and forum best suited to the claim. Our attorneys are admitted in the District of Columbia, New York, Virginia, and Maryland, and are able to litigate in both state and federal courts.
Documentation and Timeline Construction
The foundation of every strong legal position is the documentary record. We work with clients to assemble complete chronologies of communications, transactions, account actions, and representations made by the opposing party. This timeline often reveals inconsistencies, delayed responses, or contradictions that become central to the legal argument.
Structured Escalation
Our approach to escalation is deliberate. We match the level of legal pressure to the stage of the dispute: initial correspondence, formal demand, regulatory filing, and litigation are deployed in a sequence calibrated to the specific circumstances of each case. This approach creates a documented paper trail and demonstrates to opposing parties that the representation is serious, organized, and unlikely to be resolved by delay or inaction.
Honest Assessment
We tell clients what they need to hear, not what they want to hear. If a claim has weaknesses, we identify them early. If a dispute is better resolved through negotiation than litigation, we say so. Our role is to provide clear-eyed counsel—not to generate fees through unnecessary proceedings.
Established Relationships
in Key Offshore Jurisdictions
Many of the disputes our clients face involve companies operating under offshore licensing frameworks—particularly entities licensed in Curaçao, one of the world’s primary jurisdictions for iGaming, fintech, and digital financial services licensing.
Prescott & Hargrove maintains close, established counsel relationships with OX & WOLF legal partners, a Chambers Global Band 1-ranked firm based in Willemstad, Curaçao. Our working relationship with OX & WOLF—and specifically with partner Carine Jänsch, the current President of the Curaçao Bar Association and one of the Dutch Caribbean’s leading practitioners in intellectual property, iGaming regulation, and commercial litigation—gives our clients direct access to on-the-ground counsel in the jurisdiction where many offshore platforms are licensed and regulated.
This relationship allows us to coordinate cross-border demand strategies, engage local regulatory bodies, pursue enforcement actions in Dutch Caribbean courts, and apply jurisdictional pressure that U.S.-only representation cannot achieve.
